Understanding the Link Between 12A Registration and 80G Registration

While 12A registration focuses on providing income tax exemption to NGOs and charitable institutions on their income, 80G registration offers benefits to donors. Under Section 80G of the Income Tax Act, 1961, individuals or companies who donate to an organization with valid 80G registration can claim deductions on their taxable income.

This means that both registrations complement each other:

  • 12A registration = tax exemption for the NGO itself.
  • 80G registration = tax deduction for the donors.

Together, they create a win–win scenario, where NGOs retain more funds for charitable use, and donors are encouraged to contribute because of the tax benefits they receive.


Who is Eligible for 80G Registration?

Just like 12A registration, not all entities can obtain 80G registration. The Income Tax Department has laid out certain eligibility criteria for NGOs and charitable institutions to qualify:

  1. Must Have 12A Registration
    An NGO is only eligible for 80G registration if it already holds a valid 12A registration. Without this, the application for 80G will not be approved.
  2. Non-Profit Activities
    The institution must operate exclusively for charitable purposes, such as education, healthcare, environmental conservation, relief of the poor, or promoting culture.
  3. Proper Registration
    The organization must be registered as a trust, society, or Section 8 company under Indian law.
  4. No Benefit to Specific Communities or Castes
    To ensure fairness, the organization’s benefits must not be restricted to any particular caste, community, or religion (except in the case of religious institutions where the law permits).
  5. Proper Books of Accounts
    Just like for 12A registration, NGOs must maintain transparent financial records to prove that donations are used for charitable purposes.
  6. No Misuse of Donations
    Donations received should not be diverted for personal use or profit-making ventures.

Key Benefits of 80G Registration

Obtaining 80G registration is highly advantageous for NGOs because it helps them raise more funds from donors:

  1. Tax Deduction for Donors – Donors can claim a 50% or 100% deduction (depending on the category of donation) from their taxable income when they donate to an NGO with valid 80G registration.
  2. Encourages Donations – Since donors gain financial benefits, they are more willing to contribute to organizations that hold both 12A registration and 80G registration.
  3. Enhanced Credibility – Just like 12A registration adds credibility for NGOs, 80G further boosts trust among corporates, philanthropists, and the general public.
  4. Access to CSR Funding – Many companies that contribute under Corporate Social Responsibility (CSR) prefer NGOs with both 12A and 80G approvals.

Why NGOs Should Apply for Both 12A and 80G Registration

For an NGO in India, obtaining only 12A registration is not enough. While it helps in saving tax on the NGO’s income, it does not incentivize donors. With 80G registration, donors are motivated to contribute more since they enjoy tax deductions.

This combination strengthens fundraising efforts and provides financial stability to the organization. Hence, NGOs that wish to grow and sustain long-term charitable projects should always apply for both 12A registration and 80G registration.
